Sie läuft brav an der Leine, ist verträglich mit Artgenossen und freundlich zu Menschen, sie kuschelt mit Frauchen Sabine Hansen und lässt sich geduldig vom einjährigen Sohn der Familie beschmusen: Shiela ist ein perfekter Familienhund. Glaubt man dem geltenden Hundegesetz in Schleswig-Holstein, ist das gar nicht so selbstverständlich – immerhin steckt in der fast zwölfjährigen Hündin neben Border Collie und Kleinem Münsterländer auch ein American Staffordshire Bullterrier. Und der steht auf der Rasseliste der gefährlichen Hunde.

Auch deshalb saß Shiela zwei Jahre im Tierheim Itzehoe, bevor Sabine Hansen sie 2008 adoptierte. Fünf Jahre lang hat die 29-Jährige im Tierheim Hunde Gassi geführt – auch Listenhunde. „Ein Hund ist nicht gefährlich, weil er eine bestimmte Rasse hat, sondern der Mensch macht ihn gefährlich“, sagt sie. „Im Tierheim waren viele Hunde, die mit Menschen Probleme hatten, das waren alles andere Rassen wie Schäferhunde.“

Deshalb ist Sabine Hansen froh über das neue Hundegesetz, das am 1. Januar 2016 in Kraft tritt. Die Reform wurde federführend von Oliver Kumbartzky (FDP) angestoßen und mit den Stimmen von SPD, Grünen, SSW und FDP beschlossen. Mit dem Gesetz wird die umstrittene Rasseliste abgeschafft, stattdessen soll künftig das individuelle Verhalten entscheidend sein: Hunde werden nur noch dann als gefährlich eingestuft, wenn sie zum Beispiel durch Beißattacken auffällig geworden sind.

„Es ist eine sehr gute Entscheidung, dass es keine Rasseliste mehr gibt“, findet auch Hundetrainerin Stephanie La Motte aus Glückstadt. „Dadurch wurden Hunde für ein Verhalten abgestempelt, das sie gar nicht an den Tag gelegt haben.“ Gerade die vermeintlichen „Gefahrhunde“ seien, wenn sie gut erzogen und sozialisiert sind, sehr gute Familienhunde, da sie robust, aber anhänglich sind.

„Gefährliche Hunde gibt es nicht von Natur aus, gefährliche Hunde werden gemacht. Wenn der Hund auffällig wird, hat der Mensch etwas falsch gemacht, nicht der Hund“, betont die Hundetrainerin, die Mitglied im Berufsverband der Hundeerzieher- und Verhaltensberater BHV ist. Ursache seien meist Fehleinschätzungen in der Kommunikation. Wenn der Besitzer das Verhalten seines Hundes nicht richtig einschätzen könne, seine Signale nicht richtig interpretiere, komme es zu Problemen, die schlimmstenfalls in Aggression enden. Der Hebel, an dem angesetzt werden muss, sei deshalb der Hundehalter – seine Sachkompetenz müsse gestärkt werden. „Dann würde es auch mehr Rücksichtnahme geben.“ Doch genau auf diesen Schritt wird im neuen Hundegesetz verzichtet. In Niedersachsen müsse zum Beispiel jeder Hundehalter einen Hundeführerschein machen. „So werden die Leute gezwungen, sich damit auseinander zu setzen“, sagt Stephanie La Motte. Im neuen schleswig-holsteinischen Gesetz müssen nur Halter, deren Hund als gefährlich eingestuft wurde, eine theoretische und praktische Sachkundeprüfung ablegen, um den Hund weiterhin halten zu dürfen. Für alle anderen ist es keine Pflicht. „Das ist ein großer Nachteil“, bedauert La Motte.

Und auch einen anderen Punkt sieht sie mit Skepsis: Es werden keinerlei weiterreichenden fachlichen Voraussetzungen definiert, um das Tier als gefährlich einzustufen. „Jeder Tierarzt ist dazu befugt.“ Doch nicht jeder Tierarzt sei auch Verhaltensexperte. Eine engere Zusammenarbeit zwischen Ämtern, Tierärzten und Hundetrainern mit verhaltenstherapeutischem Hintergrund wäre aus ihrer Sicht wünschenswert, damit es nicht zu Fehleinschätzungen kommt. Schließlich ist eine Resozialisierung erst nach zwei Jahren möglich. Dann können Hunde nach dem Bestehen eines Wesenstestes wieder als nicht gefährlich eingestuft werden.

Hundehalter müssten sich darüber im Klaren sein, dass jetzt jeder Hund zum gefährlichen Hund werden könne, betont La Motte.Umgekehrt werde sich das Leben für Halter bisheriger Listenhunde, für die es bislang ein Spießrutenlauf war, deutlich entspannen.
